Terms and Conditions
These terms and conditions are entered into by and between Anna Miskei (hereinafter: “the Organizer”) and You (hereinafter: “the Participant”) during the … … workshop (hereinafter: the Workshop).
Service
Registration:
Registration for the Workshop is only possible through www.meetup.com. Link:
Age Limit:
The Participant confirms that he/she is 18 years old or older.
Health:
The Participant confirms that he/she will not engage in an exercise, or that would be adverse to the Participants’s health, safety or physical condition if he/she did exercise. In case of any doubt, the Participant shall seek advice by a medical doctor who should confirm the ability to exercise. The Organizer shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition. If an assessment is
done by the Organizer, it is for the sole purpose of customizing the exercises for the group more relevantly.
Insurance:
The Participant confirms that he/she holds the necessary insurances to cover any accident or training incident. The Organizer shall not be
subject to any claim, demand, or injury whatsoever with regard to the assessment of the Member’s health condition or for any injury
arising out of the Member’s disability, impairment or ailment.
Liability:
Each Participant of the Workshop shall be liable for any property damage and/or personal injury caused by the Participant at the premises of the Workshop. It shall be the obligation of the Participant to pay for any costs involved upon presentation of a statement thereof.
Waiver of Liability:
Attending the Workshop shall be at Participant’s own risk at all times. The Organizer shall not be liable for any injuries, physical impact or damages to the Participant, or the property of the Participant, or be subject to any claim arising out of the participation of the Workshop.
Lost Property or Theft:
The Organizer does not take responsibility for loss or theft of any personal belongings. Any items left in the Workshop premises will not be kept.
Use of the Workshop Premises:
The Workshop Premises shall be used for training purposes only. No other activity will be allowed, and violations will be sanctioned. Consumption of alcohol, tobacco or illegal substances is not allowed. Exercising under the influence is not allowed. Conducting business or paid services is not allowed.
Code of Conduct:
The Participant shall respect the behavioral and operating principles and follow them on all occasions. This includes, but is not limited to:
- Wearing appropriate and clean clothes and shoes.
- Behaving in a friendly and respectful manner towards the other participants of the Workshop and the Organizer.
- Any abuse be it verbal, sexual, physical will result in removal from Workshop and will result in legal proceedings.
Exclusion of the Participant:
If the Participant behaves in a way that breaches the code of conduct, disturbs other participants or the Organizer, or that the
Organizer considers inappropriate, the Participant will be suspended or excluded at Organizer’s sole discretion. In this case the any fees payed by the Participant will not be refunded.
Payment Terms
Payment:
The Participant is responsible for the full payment of the membership.
Terms:
For a valid and binding reservation to the Workshop 100% of the price has to be payed in advance. Payment of the advance can be made through www.meetup.com’s gateway using PayPal. Entering the workshop without fully completed payment will be denied.
Cancellation and Refunds:
Payments are absolutely non refundable, only in the case when the Organizer cancels the Workshop.
Participation Transfer:
In case the Participant is not able to take part in the Workshop for any reason he/she can transfer the participation right to somebody else.
Court of Jurisdiction and Applicable Law
These Terms and Conditions and all matters arising out of or relating to the participation of the Workshop and shall be governed by the substantive laws of the Czech Republic, without regards to principle of conflicts of laws thereof.
Any controversy, claim or dispute between the Organizer and Participant arising out of or relating to these Terms and Conditions
and/or the Participant’s attendance at the Workshop shall be subject to the exclusive jurisdiction to the ordinary courts of the seat of the Organizer.
